Court: Injured rail workers can’t sue NJ Transit under FELA

BERGEN COUNTY, N.J. — A three-judge panel of the U.S. Court of Appeals has ruled in favor of NJ Transit and against an injured employee in a case that could leave hundreds of the agency’s rail workers without legal protection if they’re injured. The 3rd Circuit, based in Philadelphia, ruled Tuesday that Quitman Robinson, a rail maintainer in Morristown, could not sue under the Federal Employers Liability Act because NJ Transit is an “arm of the state” and is immune to federal lawsuits.
